1. Introduction

These Terms of Use ("Terms") govern your access to and use of the website, mobile applications, internet banking, agency banking channels and any other service provided by Ellington Microfinance Bank Limited ("Ellington", "we", "us" or "our") (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, please do not use the Services. We may update these Terms from time to time, and the updated version will be effective when posted on this page.

2. Eligibility & accounts

To use our banking Services, you must be at least 18 years old and capable of entering into a binding contract. You must provide accurate, complete and current information during onboarding and keep your account details up to date.

You are responsible for maintaining the confidentiality of your login credentials, PINs, passwords and OTPs. You agree to notify us immediately of any unauthorised access to or use of your account.

3. Services we provide

Ellington provides a range of financial services that may include personal and business accounts, savings, loans, agency banking, POS services, utility payments, international transfers and related payment solutions. Specific products may have their own terms and conditions, which form part of these Terms.

4. Fees & charges

Fees, commissions, interest rates and charges applicable to our products and Services are published on our website, mobile app or communicated to you at the point of transaction. We may change our fees from time to time in line with applicable law and will notify you where required.

5. Acceptable use

You agree not to use the Services to:

  • Violate any applicable law, regulation or regulatory guidance.
  • Engage in fraud, money laundering, terrorist financing or other financial crimes.
  • Impersonate any person or misrepresent your identity or affiliation.
  • Interfere with or disrupt the integrity or performance of our systems.
  • Reverse engineer, decompile or attempt to extract source code from our applications.
  • Upload or transmit viruses, malware or any other harmful code.

6. Intellectual property

All content, trademarks, logos, software and other materials on our website and apps are owned by or licensed to Ellington and are protected by intellectual property laws. 10. Suspension & termination

We may suspend or terminate your access to the Services at any time, with or without notice, where we reasonably believe you have breached these Terms, engaged in fraudulent activity, or where required by law or regulation. You may close your account by contacting us through the channels set out below, subject to the completion of any pending transactions and regulatory obligations.

11. Governing law & disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be resolved through amicable negotiation. If unresolved, the dispute may be submitted to the courts of competent jurisdiction in Lagos, Nigeria.

12. Changes to these Terms

We may revise these Terms from time to time. Material changes will be posted on this page and, where appropriate, communicated to you through our website or mobile app. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
